18 U.S.C. § 2257 Statement

This statement concerns the record-keeping requirements of 18 U.S.C. § 2257 and § 2257A and the regulations at 28 C.F.R. Part 75. FoundFans LLC operates foundfans.com, a directory that indexes publicly available information about content creators. To the extent these requirements apply to any content appearing on the Service, FoundFans LLC complies with them; for the reasons below, FoundFans is not a producer of the content to which § 2257 principally applies.

FoundFans does not produce, host, sell, or provide access to sexually explicit content. For each listed creator, the Service displays only a limited set of already-public, non-explicit information:

• display name and public handle(s);
• public profile links and the platforms a creator publishes on;
• a single public profile photo and safe-for-work promotional images;
• a paraphrased public bio and publicly stated pricing.

Any sexually explicit material remains on the third-party platforms that FoundFans merely links to.

18 U.S.C. § 2257 imposes record-keeping duties on producers of visual depictions of actual sexually explicit conduct. FoundFans is a directory and search service. It does not create, film, or produce sexually explicit depictions, and the images it displays are non-explicit promotional or profile images. Activities limited to indexing, linking, and transmitting third-party content do not make FoundFans a producer within the meaning of the statute. Accordingly, FoundFans qualifies for the exemptions available to such services.

FoundFans links to third-party platforms it does not own or control. Each such platform is responsible for its own content and for any § 2257 record-keeping obligations arising from material it produces or hosts. Questions about records for specific explicit content should be directed to the platform or producer that created and hosts it.

FoundFans is an adults-only service and lists only adult creators. The source platforms we index require their creators to be at least 18 and to complete identity and age verification before publishing. FoundFans reasonably relies on that verification and does not knowingly list any person under 18. If you believe any listing depicts a minor, report it immediately to [email protected] and we will remove it.
